These Terms and Conditions (“Terms”) constitute a legally binding and enforceable agreement between RunVoyage, located at Gan Yavne, Israel (“we”, “our”, or “us”), and any user who accesses, browses, uses, purchases services through, or otherwise interacts with the RunVoyage mobile application and related digital platforms (“user”, “you”, or “your”).
Acceptance of the Terms
THESE TERMS, TOGETHER WITH OUR PRIVACY POLICY AND ANY ADDITIONAL TERMS MADE AVAILABLE THROUGH THE APPLICATION (COLLECTIVELY, THE “TERMS”), GOVERN YOUR USE OF THE RUNVOYAGE APPLICATION. BY ACCESSING OR USING THE APPLICATION, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE APPLICATION.
Eligibility and Age Restriction
Use of the Application and its Services is intended for individuals who are at least 18 years old. By using the Application, you represent and warrant that you meet this requirement and are legally capable of entering into these Terms.
Amendments of the Terms
We reserve the right to amend or revise these Terms at any time at our sole discretion. Updated Terms will become effective immediately upon publication within the Application. Continued use of the Application after such updates constitutes acceptance of the revised Terms.
The Application, Services and Content
RunVoyage is a travel planning application that allows users to:
- Create personalized travel plans and routes
- Select attractions and points of interest
- Save personal notes, images, and preferences
- View and edit routes on interactive maps
- Receive descriptive information about attractions
- Update itineraries
- Share trips and invite participants
Travel planning functionality is provided free of charge.
All content provided in the Application, including text, descriptions, routes, maps, images, and recommendations (“Content”), is provided for general informational purposes only and does not constitute professional, legal, travel, safety, or medical advice.
We make reasonable efforts to ensure accuracy, but do not guarantee that the Content is complete, current, or error-free. Use of the Content is at your own risk.
Affiliate Links and Third-Party Services
The Application may include links to third-party websites offering tickets, attractions, guided tours, or related services. In such cases, RunVoyage acts solely as an affiliate.
All purchases are made directly with third-party providers
- RunVoyage is not the seller, organizer, or service provider
- Prices, availability, cancellations, refunds, and service quality are governed exclusively by the third party’s terms
We disclaim all responsibility for third-party services, content, or transactions.
Pre-Planned Routes and Paid Digital Products
RunVoyage may offer pre-planned travel routes available for purchase.
Purchased routes grant a personal, non-transferable license for use
Routes may not be copied, shared, resold, or redistributed
Prices may change at any time
No guarantee is made that a route will suit personal preferences, conditions, or circumstances
Payments
Payments are processed through third-party payment providers. You agree to provide accurate payment information and authorize applicable charges. When completing any online transaction, you will be required to enter complete and accurate information requested by us or the system, including your first name, last name, full address, government ID number, email address, and payment details.Approval from the credit card company used for the online booking is required to confirm the transaction.
We are not responsible for errors caused by incorrect information provided by you.
Cancellation and Refunds
Digital products (including pre-planned routes) are subject to applicable consumer protection laws. Unless otherwise required by law, digital content delivered immediately after purchase is non-refundable.
Affiliate purchases must be canceled directly with the third-party provider.
Use Restrictions
You agree not to:
- Use the Application unlawfully or fraudulently
- Copy, reproduce, distribute, or exploit Content without permission
- Use the Application for commercial purposes without authorization
- Interfere with security or technical functionality
- Infringe intellectual property or privacy rights
We reserve the right to suspend or terminate access for violations.
Intellectual Property
All rights in the Application and Content (excluding third-party materials) are owned by or licensed to RunVoyage. No rights are granted except as expressly stated in these Terms.
Third-Party Content
The Application may include links or references to third-party websites or services. We do not control and are not responsible for third-party content, policies, or practices. Use of such services is at your own risk.
Privacy
Our Privacy Policy governs the collection and use of personal data and is incorporated into these Terms by reference.
Availability and Changes
We may modify, suspend, or discontinue the Application or any feature at any time without notice. Availability is not guaranteed.
Disclaimer and Limitation of Liability
THE APPLICATION AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUNVOYAGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING FROM USE OF THE APPLICATION OR CONTENT.
Indemnification
You agree to indemnify and hold RunVoyage harmless from any claims, damages, or expenses arising from your use of the Application in violation of these Terms or applicable law.
Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Israel. Exclusive jurisdiction shall lie with the competent courts in Tel Aviv, Israel.
Miscellaneous
Entire Agreement - these Terms constitutes the entire understanding between the parties relating to the subject matter herein.
Assignment - these Terms and any right granted herein shall not be assigned by you without our prior written consent. We may assign our rights and obligations set forth herein at any time, at its sole discretion.
Severability – should one or more of the provisions of these Terms be determined to be invalid, unlawful, or unenforceable in any respect, the validity, legality, and enforceability of the remaining provisions of these Terms shall not in any way be affected or impaired by such determination and will remain in full force and effect, and the provision affected will be construed to be enforceable to the maximum extent permissible by law.
Waiver - without derogating from the above, any delay or omission by either party to exercise any right under these Terms shall not be construed to be a waiver of such right. A waiver by either party of any of the performance provisions of these Terms shall not be construed to be a waiver of any succeeding performance or breach.
